We may from, time to time, alter the terms of this privacy policy in response to new laws, technologies and business practices.

Please review this policy periodically to check for changes. The latest version of the policy governs the way we store and use your membership information held by us.

We are committed to respecting the privacy of our members. The following policy outlines how personal information received by us will be dealt with.

Although not required by law to do so, we seek to adopt the Privacy Act 1988 in dealing with our customers. We do this to better ensure that our members will have confidence that FIRSTKISS is committed to excellence and security.
In this privacy policy, "us", "we" or "our" means FIRSTKISS.COM.AU Pty Ltd (ACN 125796947) ("FIRSTKISS").

A.    Information Protection Principles

  1. FIRSTKISS must not do anything, or engage in any practice, that contravenes any information protection principles contained in the Privacy Act 1988. In particular FIRSTKISS declares that it will:

    1. Not collect personal information unless:

      1. the information is collected for a lawful purpose that is directly related to a function or activity of FIRSTKISS, and

      2. the collection of the information is reasonably necessary for that purpose;

    2. Not collect personal information by any unlawful means;

    3. Collect sensitive information only when you have consented;

    4. Collect the information directly from the individual;

    5. Make the individual to whom the information relates aware of:

      1. the fact that the information is being collected; and

      2. the purposes for which the information is being collected; and

      3. the intended recipients of the information; and

      4. whether the supply of the information by the individual is required by law or is voluntary, and any consequences for the individual if the information (or any part of it) is not provided; and

      5. the existence of any right of access to, and correction of, the information; and

      6. the name of the company that is collecting the information and the company that is to hold the information, and how to contact them.

  2. FIRSTKISS will use its best endeavours that any information is disposed of securely, that the information is protected against loss, unauthorised access, use, modification or disclosure, etc.

  3. FIRSTKISS will use its best endeavours to ensure that all reasonable measures are taken to prevent unauthorised use or disclosure of the information.

  4. FIRSTKISS will make appropriate amendments (whether by way of corrections, deletions or additions) to ensure that the personal information is accurate, and relevant, up to date, complete and not misleading.

  5. FIRSTKISS will not use the information for a purpose other than that for which it was collected unless:

    1. the member to whom the information relates has consented to the use of the information for that other purpose, or

    2. the use of the information for that other purpose is necessary to prevent or lessen a serious and imminent threat to the life or health of the member to whom the information relates or of another person;

    3. the disclosure is necessary in the opinion of FIRSTKISS to prevent or lessen a serious and imminent threat to the life or health of the individual concerned or another person;

  6. For the purposes of this privacy policy, "personal information" means information or an opinion (including information or an opinion forming part of a database and whether or not recorded in a material form) about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion. Examples of personal information include your photograph, date of birth and gender.

  7. For the purposes of this privacy policy, "sensitive information" is information or an opinion about your racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences or practices, criminal record that is also personal information or health information about an individual.

B.    Information Firstkiss collect

  1. We collect two types of information about you:-

    1. Information supplied directly from you to us via our membership program, and

    2. Information collected concerning your use of our website.

  2. Information you supply to us may include, but is not limited to name, email address, ethnicity, religion, age, marital status, sexual preferences and other information as required to complete your member profile. Personal and sensitive information collected about you will only be used for the purpose for which it was intended.

  3. We do not collect or store financial details because our membership program is a free service.

  4. We record network (Intellectual Property) information relating to how you access our service, including Intellectual Property addresses, dates and times, and pages visited.

C.     Use of Information

  1. We generally use the information collected about you to:
    1. provide you with products and services you have requested from FIRSTKISS, including posting your member profile on our website.
    2. promote products and/or services which may be relevant to you.
    3. enable us to enhance, expand and personalise the services provided to you by FIRSTKISS.
    4. communicate with you (including delivering messages from other FIRSTKISS members to you).
    5. provide you, from time to time, with email and newsletters related to FIRSTKISS;
    6. provide you with ongoing information and opportunities from FIRSTKISS we believe you may be interested in;
    7. investigate complaints and grievances made about you or made by you, and;
    8. investigate your membership if we believe you are or have been using our website in breach of the Terms & Conditions or if we have reason to believe you are or have been conducting illegal activity.

D.     Disclosure of Information

  1. You agree that any information that you provide to us is non confidential unless specifically advised to the contrary. You agree that we may disclose any such information to any third party for any purpose.

  2. FIRSTKISS may provide information to third parties:-

    1. engaged by FIRSTKISS to perform functions on its behalf, such as marketing, research, mailouts and advertising;

    2. authorised by you to receive information held by us;

    3. as authorised or required under any law.

  3. FIRSTKISS may share usage information about visitors to, and members of our website to our advertising and analytics partners for the purpose of targeting advertising and collecting usage statistics. You agree that we will be entitled to track, and make a record of, your activity on our website.

  4. You agree that we may share information about you with other members of our website, provided that information has been made available in a public part of our website, including public details of your profile.
